Federal question jurisdiction in this private civil action is founded on section 1964(c) of the Racketeer Influenced and Corrupt Organizations Statute (RICO), 18 U.S.C. §§ 1961 et seq.*fn1 Count one of the complaint alleges that defendants have conspired, and have engaged, in a pattern of racketeering activity in violation of 18 U.S.C. § 1962(c) and (d) with the result that plaintiffs have been defrauded of approximately $8,300,000. In addition, counts two through four of the complaint assert claims under state law founded upon the district court's pendent jurisdiction. In count two plaintiffs allege a breach of fiduciary duties, in count three they allege common law fraud, and in count four breach of contract.
